34. In addition, the Bill introduces a new offence criminalising the
procurement of sexual activity where consent is obtained by deception or
false representation regarding (a) the use or manner of use of a sexually
protective device, or (b) whether one is suffering from a sexually
transmitted disease. In such cases, while consent is not legally negated (as
the deception does not relate to the nature of the act, the purpose of the
act, or the identity of the person doing the act), the consent obtained is
compromised, and there is risk of physical harm to the victim.

由於外文程度不是很好，先大概看了修正草案還有英國跟瑞士的新聞依照外國目前的實務，就是只要做出違反於性行為前所約定的行為（ex偷脫保險套、故意體內射精告知後不給反應時間）就可以算在強暴的法律定義裏面？大概知道了，解決了很多疑惑，非常感謝！

說是才算是，這種老梗了。問題是「一般女人」的日常行為裡面，就是有一堆不照這種規則辦理。通過這種法條當然有機會讓法官審判更簡潔有力，但是這種立法意旨就是不顧當事人真意去硬幹。又是定在刑法。就算真能通過，日後預期會引發一大堆爭議。古時候也一群權勢者規定新的一年起於一月一日，大家要過新年的話要過這個法定新年，結果呢?

大概看了一下，觀念清楚很多，謝謝推薦文章所以主要觀點就是要在法律上，保護「被欺詐而同意性交、承擔性行為後產生的重大風險（ex懷孕、性病）之受害人的性自主權」吧？國外類似的案例居然這麼多，個人滿訝異的
