[選]試 譯 文：Subject to the terms and conditions of the Agreement, including,
without limitation, payment of the applicable license and design fee(s), Party
B hereby grants to Party A, and Party A hereby accepts from Party B, an
exclusive, non-transferable license to use the designs and graphics as
described in this Agreement, unless otherwise agreed to in this agreement.
The license will be provided on “as is” basis. Parties agree that the
designs as described in Appendix 1 are explicitly excluded from this agreement.
Party A will not receive and is never allowed to use the designs and graphic
works as described in appendix 1. For every violation Party A will directly
after a notification from Party B pay an amount of EUR 250.000 to Party B.
