我覺得先不用想這麼多。
只要目前/將來在美國完全沒廠，就是吃關稅。
至於能不能在美國有廠，也要看美國要不要讓你蓋。
i.e. 中芯大概 GG。目前沒有的，例如聯電之類可能要去問美國給不給蓋
怎樣算在美國設廠，至少也要在美國現在/將來有廠房才有下一步認定問題。
