我的案例可能比較特殊
照我們法務的說法
要符合這三個條件
1. our proposed job duties and specialized knowledge show that you will provide
significant and unique contributions to the Company
2. Your specialized knowledge is specifically related to a critical
infrastructure need (e.g., Information Technology); and
3.You have spent multiple years with the company abroad, indicating a
substantial knowledge and expertise within the organization.
依照最新的order, IT也可以算是exemption.
我準備了包含律師信, 我的OFFER, exempation的解釋,我自己的專利 ... 能準備的
都準備了.
不過面試官都沒看...
他只問了一句
"What will you work on in the United State?"
因為我剛好在做 department of defense的project
說到DOD 他就說沒問題了.
